1. Scope
These Terms and Conditions apply to all contracts relating to digital products concluded between
Melissa Dornblut
trading as “Coastal Island Studio”
An der Brücke 3
04178 Leipzig
Germany
(hereinafter referred to as the “Provider”)
and the Customer via the website.
Any deviating terms and conditions of the Customer shall not be accepted unless their applicability has been expressly agreed to in writing.
2. Subject Matter of the Contract
The subject matter of the contract is the provision of digital content in the form of digital maps, travel editions, collections, downloads or comparable digital products.
The products offered are provided exclusively in digital form.
No physical goods will be shipped.
3. Conclusion of the Contract
The presentation of the products on the website does not constitute a legally binding offer, but an invitation to place an order.
By completing the ordering process, the Customer submits a binding offer to purchase the selected product.
The contract is concluded as soon as the order has been accepted and payment processing has been successfully completed.
The Customer will receive a confirmation by email.
4. Prices and Payment Terms
All prices stated are final prices.
Pursuant to Section 19 UStG, no VAT is shown.
Payment shall be made using the payment methods offered during the ordering process.
The entitlement to receive the digital product arises only after successful receipt of payment.
5. Provision of Digital Content
The digital content will be made available to the Customer electronically after successful payment.
Provision will take place by download, email or a secure access link.
The Customer is responsible for ensuring that suitable technical requirements are available for accessing and using the digital content.
6. Rights of Use
Upon purchasing a product, the Customer receives a simple, non-exclusive, non-transferable and revocable at any time right of use for the private use of the purchased digital content.
Use is permitted exclusively for the Customer’s own private purposes.
In particular, the Customer is prohibited from:
- reselling digital products or parts thereof,
- renting or lending digital products or parts thereof,
- making digital products publicly accessible,
- reproducing or distributing digital products,
- making digital products available to third parties,
- using digital products for commercial purposes,
- adopting or reproducing, in whole or in part, content, data, map structures, categories or collections of locations.
The right of use covers exclusively the personal use of the purchased product. All further rights remain with the Provider.
7. Copyright Protection and Protection of the Curation Work
All content, maps, graphics, texts, designs, location markers, categories, classifications, selection criteria, collections, structures and other components of the products offered are protected by copyright or other intellectual property rights.
In particular, the individual selection, compilation, arrangement, structuring, categorisation and curatorial preparation of the locations and content presented are also protected.
Any complete or partial adoption, reproduction, duplication, publication, distribution or commercial use of this curation work is prohibited without the Provider’s prior express written consent.
The systematic evaluation, extraction, digitisation, storage, analysis or use of the content or parts thereof for the purpose of creating the Customer’s own map services, travel products, databases, information collections, recommendation platforms or comparable services is also prohibited.
The use of the content for training, testing, optimising or operating artificial intelligence, machine-learning systems, automated evaluation systems or data collection systems is also prohibited without the Provider’s express prior written consent.
In the event of infringements, the Provider expressly reserves the right to assert all civil-law claims.
8. Right of Withdrawal for Digital Content
Consumers generally have a statutory right of withdrawal.
However, the right of withdrawal expires in the case of contracts for digital content that is not supplied on a tangible medium if
- the Provider has begun performing the contract,
- the Consumer has expressly consented to performance of the contract beginning before the expiry of the withdrawal period, and
- the Consumer has confirmed their knowledge that, by giving this consent, they lose their right of withdrawal.
The corresponding consent is given during the ordering process.
9. Warranty
The statutory warranty rights apply.
The Provider does not warrant that the information provided will meet the Customer’s personal expectations or that specific travel outcomes will be achieved.
10. Liability
The Provider shall be liable without limitation for damages resulting from injury to life, body or health and for damages based on intent or gross negligence.
In the event of a slightly negligent breach of essential contractual obligations, liability shall be limited to the foreseeable damage typical for this type of contract.
In all other respects, liability is excluded to the extent permitted by law.
11. Travel and Location Information
The maps and information provided are intended exclusively for general orientation and inspiration.
Despite careful research, no guarantee can be given regarding the accuracy, completeness or permanent accessibility of individual locations.
Local conditions, access options, opening hours, weather conditions, safety situations, nature conservation regulations or legal requirements may change at any time.
The Customer is required to independently obtain information about the current conditions before visiting a location.
The Provider accepts no liability for decisions, actions or travel planning undertaken on the basis of the content provided.
12. Applicable Law
The law of the Federal Republic of Germany shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods.
For Consumers, this choice of law shall apply only insofar as it does not deprive them of the protection afforded by mandatory provisions of the country in which the Consumer has their habitual residence.
13. Consumer Dispute Resolution
The Provider is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
14. Final Provisions
Should individual provisions of these Terms and Conditions be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
